Terms of Service
These Terms govern your use of https://turbovisionforge.com and the cybersecurity services provided by TurboVisionForge LLC ("TurboVisionForge," "we," "us"), a limited liability company organized in Florida, United States. Our services are sold to businesses; by engaging us you confirm you are acting on behalf of an organization.
1. Engagements and scope
Each engagement is defined by a written statement of work (an "SOW") or, for purchases made through this site, by the engagement description plus a follow-up scoping confirmation. The prices shown on the site are starting points for a typical scope; the binding fee is the one we confirm in writing after scoping. Work outside the agreed scope is handled by a written change order before it begins.
2. Authorization & rules of engagement
This is critical for any offensive work. Before we conduct penetration testing, red-team operations, or any active assessment, you must sign a rules-of-engagement and authorization document confirming that you own — or are legally authorized to permit testing of — every in-scope system. You agree that testing of systems you do not own or control requires their owner's written authorization, and that you are responsible for obtaining it. We will not begin offensive testing without this authorization on file.
3. Fees, payment, and taxes
Fixed-scope engagements and IR hour banks are charged when you purchase or as set out in the SOW. Operations Retainers are billed monthly in advance through Stripe and continue until cancelled with 30 days written notice. All prices are in US dollars and exclusive of any applicable sales tax, which is added where required. Invoices not paid through checkout are due on the terms stated on the invoice; overdue balances may accrue interest at the lower of 1.5% per month or the maximum rate permitted by Florida law.
4. Incident-response hour banks
Prepaid IR hours are drawn down against actual response work at the rates in your agreement. Unused hours remain available for twelve months from purchase and may be applied to tabletop exercises, runbook development, or detection work. The hotline is staffed 24/7 for clients holding an active bank or retainer.
5. Deliverables and intellectual property
Upon full payment, reports and other deliverables we create specifically for you are yours to use within your organization. We retain ownership of our pre-existing tools, methodologies, templates, and general know-how, and we may use the skills and non-confidential techniques developed during an engagement in future work. We will not disclose your confidential information or use it outside your engagement.
6. Confidentiality
Each party will protect the other's confidential information — which for you includes the very existence and findings of a security engagement — for three years after the engagement ends, using at least the care it uses for its own confidential information. We are happy to sign your NDA in addition to these Terms.
7. Warranty and disclaimer
We perform our services in a professional and workmanlike manner consistent with industry standards. Security testing has inherent limits: an assessment reflects a point in time and cannot guarantee that every vulnerability has been found or that a system is "secure." Except as expressly stated, services are provided "as is" and we disclaim all other warranties to the fullest extent permitted by law.
8. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, or consequential damages, and our aggregate liability arising out of an engagement is limited to the fees you paid us for that engagement in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited by law, including for a party's gross negligence or willful misconduct.
9. Client responsibilities
You agree to provide timely access, accurate information, and a named point of contact; to maintain your own backups before testing begins; and to acknowledge that active testing carries a small inherent risk of service disruption, which we mitigate through careful scoping and agreed testing windows.
10. No unlawful use
You agree not to use any deliverable, tool, or technique we provide to attack systems you are not authorized to test, or for any unlawful purpose. Our work is provided solely for the defensive benefit of the authorized client.
11. Governing law
These Terms are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Orange County, Florida, and each party consents to that jurisdiction.
